This is to clarify that the truck apprehended by the DENR Community Environment and Natural Resources Office (CENRO) Matalam on 08 September 2022 at Kidapawan City is not owned by MSSD.
D’ Paragon AA Corporation used the intercepted truck in transporting the procured lumbers and materials after being awarded by MSSD with the contract to supply and deliver the products needed for the construction of WASH facilities in Maguindanao, Lanao del Sur A, Basilan, and Sulu.
Prior to this, the bidding process was done in accordance with the Republic Act No. 9184 (Government Procurement Reform Act). Being declared as the Lowest Calculated and Responsive Bidder (LCRB), D’ Paragon AA Corporation was deemed qualified to supply and deliver the necessary materials.
However, there is no specific type of lumber indicated on the list of construction materials in the bid document, only that it should be “good lumber”.
As such, the goods intercepted prior to receipt by MSSD are not yet deemed delivered nor in its possession.
Furthermore, the supplier is responsible for securing the necessary permits, which should have been prepared prior to delivery.
To reiterate, the responsibility of applying for permits to effect delivery of goods lies with the supplier and not with the procuring entity.
Meanwhile, the Ministry expresses its commitment in coordinating with the authorities for the investigation of the alleged illegal transportation of the undocumented forest products.
